1. About Us
NEXOVIK (formerly SparkPixel) is a web design and digital solutions provider based in Birmingham, United Kingdom. We are a sole trader operation. These terms govern all services we provide, including website design, domain assistance, hosting recommendations, and related digital services.
2. Services
We provide bespoke web design, domain registration assistance, and digital consultancy. All project specifics — including scope, deliverables, timelines, and revisions — are agreed in writing (via email or contract) before work begins. We do not offer refunds on completed work unless the deliverables materially fail to match the agreed specification.
3. Payment Terms
Unless otherwise agreed, we require a 50% deposit before commencing work, with the remaining 50% due on completion prior to site launch. Invoices are payable within 14 days. Late payments may incur interest at 8% per annum above the Bank of England base rate, as permitted under the Late Payment of Commercial Debts (Interest) Act 1998.
4. Intellectual Property
Upon full payment, you own the final website design and code we produce specifically for your project. We retain rights to any reusable frameworks, libraries, or pre-built components. We reserve the right to display completed work in our portfolio unless you request otherwise in writing.
5. Domain Registration
We currently recommend Cloudflare Registrar for domain purchases. Domain names are registered in your name and remain your property. We do not charge markup on domain registrations. We are not liable for domain expiry, loss, or suspension — it is your responsibility to maintain registration and renew on time.
6. Hosting
We do not operate our own hosting infrastructure. We recommend third-party hosting providers and can assist with setup and migration. We are not responsible for hosting downtime, data loss, or security breaches occurring on third-party hosting platforms. Our own domain hosting service is in development and will be offered separately when ready.
7. Limitation of Liability
To the fullest extent permitted by law, our total liability for any claim arising from our services shall not exceed the total amount you paid us for the project in question. We are not liable for indirect, consequential, or loss-of-profit damages. Nothing in these terms excludes liability for death or personal injury caused by our negligence.
8. Cancellation
You may cancel a project before work begins for a full refund of any deposit paid. If work has commenced, the deposit is non-refundable but covers work completed to date. We may cancel a project if payment is not received within 30 days of invoice, in which case all work remains our property until full payment is made.
9. Data Protection
We process personal data in accordance with the UK GDPR and the Data Protection Act 2018. See our Privacy Policy for full details.
10. Governing Law
These terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to These Terms
We may update these terms from time to time. The current version will always be available on this page. Continued use of our services after changes constitutes acceptance of the updated terms.
